Sponsor. This giveaway is sponsored by 1661, Inc. dba GOAT, P.O. Box 91258, Los Angeles, CA 90009 (the “Sponsor”).
Timing. The giveaway will run beginning at 3:00 PM PT on Thursday, November 16, 2023 and ending at 12:00 PM PT on Friday, November 24, 2023 (the “Giveaway Period”).
How to enter. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER. VOID WHERE PROHIBITED. The giveaway takes place via the official GOAT mobile application for iOS and Android (the “GOAT App”) and YouTube, and is administered according to the terms as provided herein. The GOAT App is available for download at no charge. To enter the giveaway for the chance to win a Grand Prize, participants must download the GOAT app via one of the giveaway links (the “Giveaway Links”) provided in the description of the GOAT Black Friday video (the “Giveaway Video”) posted on the YouTube channel @ishowspeed on November 16, 2023. To enter the giveaway for the chance to win a Video Prize, participants must have or download the GOAT app via the Giveaway Links and must post a comment on the Giveaway Video.
Sponsor reserves the right at its sole discretion to disqualify any individual (and all of their entries) who fails to follow the entry instructions or fails to provide all required information, tampers with the entry process or who Sponsor believes or suspects has violated these Official Rules. Sponsor reserves the right to suspend or terminate an individual’s account or delete any listings that fail to comply with these Official Rules. Automated entries are prohibited and any use of automated devices, robots, mechanical, programmed or similar methods for obtaining entry will lead to disqualification. Sponsor reserves the right to cancel, terminate or modify the giveaway if it cannot be operated, conducted or completed as planned, for any reason.
Sponsor and its subsidiaries and affiliates are not responsible for late, lost, delayed, unclear, incomplete, misdirected or ineligible entries which will be disqualified or for technical, hardware or software malfunctions of any kind, lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the giveaway which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in the giveaway. All decisions by Sponsor regarding the provision of tickets are binding in all respects.
Eligibility. The giveaway is open to individuals who are eligible to open and maintain a GOAT Account and are eighteen (18) or older at the time of entry. All applicable laws and regulations apply. VOID WHERE PROHIBITED OR RESTRICTED, INCLUDING, BUT NOT LIMITED TO, RESIDENTS OF QUEBEC, CANADA, WHO ARE NOT ELIGIBLE TO PARTICIPATE. Participation constitutes participant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the giveaway. The following individuals are not eligible to participate in the giveaway: (a) directors, employees, and representatives of GOAT Group and (b) the immediate family (i.e., spouse, parents and step-parents, siblings and step-siblings, and children and step-children, regardless of where they reside) and household of each such individual. A participant may be required to provide proof he/she is the person with the registered GOAT Account to be eligible to claim an item.
Recipient(s). On the last day of the Giveaway Period, Sponsor or an agent of Sponsor will randomly select five (5) “Video Prize Winners” and three (3) “Grand Prize Winners”. Five (5) Video Prize Winners will be randomly selected from the comments posted to the Giveaway Video during the Giveaway Period. Three (3) “Grand Prize Winners” will be randomly selected from all participants who download the GOAT App via the Giveaway Link that Sponsor determines, in its sole discretion, generated the highest number of GOAT App downloads during the Giveaway Period (the “Winning Giveaway Link”).
All potential winners are subject to verification before any prize will be awarded. Sponsor will attempt to contact the potential Winners through YouTube within approximately 48 hours after the end of the Giveaway Period. If any prize notification, prize, or giveaway communication is rejected or returned as undeliverable or if a recipient cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such recipient may be disqualified and an alternate recipient may be selected from all eligible entries. Upon item forfeiture, no compensation will be given to the potential winner. Limit of one (1) prize per person during the giveaway. Please ensure that email and GOAT App settings are set up to allow for receipt of email communications or push notifications from Sponsor. Sponsor assumes no responsibility for undeliverable item notifications resulting from undelivered messages, any form of active or passive filtering by participant’s account or email settings or for insufficient space in a participant’s user account to receive notifications or emails.
Prizes/odds. Video Prize Winners may receive one of the following prizes: (i) Ben & Jerry's x Dunk Low SB 'Chunky Dunky' Shoe (size 9); (ii) LV X Air Force 1 Low 'White Comet Red' Shoe (size 8); (iii) BAPE Black Friday Collaboration Pack; (iv) PSG signed Mbappe Jersey No. 1; or (v) PSG signed Mbappe Jersey No. 2. Each of the Grand Prize Winners will receive one (1) $5,000.00 USD deposit of GOAT Credit directly into the Grand Prize Winner’s GOAT account. Odds of winning a prize depend on the number of eligible entries received during the Giveaway Period. All prize(s) legitimately claimed will be awarded. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. In addition, Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion thereof) of comparable or greater value whether due to the unavailability of a prize or prize component, or for any other reason. Prize(s) are non-refundable and must be accepted as awarded. Winners will be solely responsible for any applicable shipping fees, taxes and duties for any prizes.
In the event a potential item winner is not able to meet the requirements for claiming the item, such winner shall not be entitled to the item, or any other item, compensation or monetary value whatsoever, and Sponsor will have no further obligation to the potential winner.
Taxes. Under prevailing federal, state, and local tax rules and regulations, a prize may constitute taxable income to a recipient. Please consult with a tax professional to discuss the tax implications of acceptance of a prize. Recipients are solely responsible for any federal, state, or local taxes that may be due on a prize or the value of a prize.
Advertising and marketing. By entering the giveaway, and in consideration of Sponsor’s potential review and evaluation of his or her entry, each participant acknowledges and agrees that his or her entry constitutes Registered User Content as defined in the Terms of Use and grants to Sponsor the non-exclusive right to use his or her entry as provided in the Terms of Use. To the maximum extent permitted by law, by accepting a prize, a participant consents on their own behalf, to the print and online publication of such participant’s GOAT username, YouTube username and stated country of residence as part of any announcement of the winner(s) of this giveaway on Sponsor’s website (and to submit this information, along with such winning participant’s first and last name, address, phone, email or other contact information to governmental agencies if required by applicable law) without additional compensation other than the consideration specified in this paragraph for the entire protection term of the rights concerned and for all methods and means of exploitation. Each participant whose personal information is being so used by Sponsor may request access to his or her personal information held by Sponsor and that Sponsor correct the data if it is inaccurate or delete the data if Sponsor is not required to retain it by law or for legitimate business purposes. Access, correction, deletion requests or withdrawal of consents can be made by contacting Sponsor by email at privacy@goat.com or by mail at the address identified in the section “Winning participant list” below, however, no consent withdrawal will apply retroactively to any participant's personal information used prior to Sponsor's receipt of any consent withdrawal. Other than as set forth herein, Sponsor will treat any personal information supplied by participants in connection with the giveaway in accordance with Sponsor's Privacy Policy.
NOTE ABOUT SOCIAL MEDIA PLATFORMS. Sponsor is not responsible for any changes or unavailability of any social media platform, including, but not limited to, YouTube, Facebook, Instagram, Snapchat, TikTok, or Twitter that may interfere with the giveaway, including any limitations, restrictions, or conditions on Sponsor’s ability to use any social media platform for the giveaway as set forth in these Official Rules that are not acceptable to Sponsor or the inability of participants to post content, share, or communicate with Sponsor via any social media platform. Your use of any social media platform is subject to the terms and conditions set by such social media platform.
LIMITATION OF LIABILITY/REQUIREMENTS. By entering, participant agrees to release, defend, hold harmless and indemnify Sponsor and its respective parents, subsidiaries, affiliates, contractors, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of any injuries, losses, or damages of any kind caused by the acceptance, possession, use or misuse of a prize awarded in the giveaway, including but not limited to any claims for damage to property, personal injury, death or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery. False or deceptive entries or acts will render the participant ineligible. By entering, participant further agrees that (i) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (ii) all causes of action arising out of or connected with this giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for any printing or typographical errors in these Official Rules or any other materials associated with the giveaway.
By entering this giveaway and accepting a prize, each participant agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any giveaway activity, including use of a prize. Each participant further agrees to adhere to the Terms of Use, including but not limited to the prohibition on defamatory, obscene, pornographic, vulgar, or offensive content by such participants.
Participants enter at their own risk and the Sponsor is not responsible for and shall not be liable for any condition caused by events beyond its control that may cause the giveaway to be disrupted or corrupted. Failure to comply with these Official Rules may result in disqualification from this giveaway.
Should any portion of the giveaway be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the giveaway and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to such action. Sponsor reserves the right to revise these Official Rules at any time.
Choice of law/venue. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of participant and Sponsor in connection with the giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to the conflict of laws rules thereof, and any matters or proceedings shall take place in the city of Los Angeles, California.
Winning participant(s) list. For the names of the winning participants, send a legal-size, self-addressed, stamped envelope to: 1661, Inc. dba GOAT, attn: GOAT Black Friday Giveaway Winners’ List, P.O. Box 91258, Los Angeles, CA 90009-1258. Requests must be received no later than three (3) months following the close of the giveaway.
