Sponsor. This giveaway is sponsored by 1661, Inc. dba GOAT, P.O. Box 91258, Los Angeles, CA 90009-1258 (the “Sponsor”).
Timing. The giveaway will run beginning at 10:00 AM PST on Monday, December 4, 2023, and ending at 10:00 AM PT on Saturday, December 9, 2023 (the “Giveaway Period”).
How to enter. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER. VOID WHERE PROHIBITED. To enter the giveaway, participants must: (1) follow @GOAT and @GOATSneakers on Instagram; (2) like the Instagram collab post between @GOAT and @GOATSneakers that is posted on December 4, 2023, regarding the giveaway (the “Giveaway Post”); and (3) tag one friend in the comments on the Giveaway Post.
The giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering this giveaway, participants hereby release Instagram of any liability in connection with the giveaway.
Sponsor reserves the right at its sole discretion to disqualify any individual (and all of their entries) who fails to follow the entry instructions or fails to provide all required information, tampers with the entry process or who Sponsor believes or suspects has violated these Official Rules. Automated entries are prohibited and any use of automated devices, robots, mechanical, programmed or similar methods for obtaining entry will lead to disqualification. Sponsor reserves the right to cancel, terminate or modify the giveaway if it cannot be operated, conducted or completed as planned, for any reason.
Sponsor and its subsidiaries and affiliates are not responsible for late, lost, delayed, unclear, incomplete, misdirected or ineligible entries which will be disqualified or for technical, hardware or software malfunctions of any kind, lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the giveaway which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in the giveaway.
Eligibility. The giveaway is open to individuals who are eighteen (18) or older at the time of entry. All applicable laws and regulations apply. VOID WHERE PROHIBITED OR RESTRICTED, INCLUDING, BUT NOT LIMITED TO, RESIDENTS OF QUEBEC, CANADA, WHO ARE NOT ELIGIBLE TO PARTICIPATE. Participation constitutes participant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the giveaway. The following individuals are not eligible to participate in the giveaway: (a) directors, employees, and representatives of GOAT Group and (b) the immediate family (i.e., spouse, parents and step-parents, siblings and step-siblings, and children and step-children, regardless of where they reside) and household of each such individual.
Recipient(s). On the last day of the Giveaway Period, Sponsor will randomly select two (2) winners from all eligible entries received during the Giveaway Period. The winner(s) will be notified via comment on the Giveaway Post no later than 11:59 PM PST on December 9, 2023. Any prize not claimed within seven (7) days of prize notification will be forfeited. If any prize notification, prize, or giveaway communication is rejected or returned as undeliverable or if a recipient cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such recipient may be disqualified and an alternate recipient may be selected from all eligible entries. Upon prize forfeiture, no compensation will be given. All potential winners are subject to verification and acceptance of these Official Rules before any prize will be awarded. Limit of one (1) prize per person during the giveaway. Sponsor assumes no responsibility for undeliverable item notifications resulting from undelivered messages, any form of active or passive filtering by participant’s Instagram account or email settings.
Prizes/odds. There will be two (2) prizes awarded during the giveaway. The approximate retail value (“ARV”) of all available prizes is $5,469 USD. “Prize 1” will consist of one (1) pair of each of the following pairs of sneakers, each in a US Men’s Size 10: Air Jordan 11 Retro ‘Gratitude’ (2023), Air Jordan 11 Retro ‘Cool Grey’ (2021), Air Jordan 11 Retro ‘Space Jam’ (2016), Air Jordan 11 Retro ‘Concord’ (2018), Air Jordan 11 Retro ‘Bred’ (2019) and Air Jordan 11 Retro ‘Pantone’ (2014) (collectively, ARV of $2,723 USD). “Prize 2” will consist of one (1) pair of Air Jordan 11 Retro ‘Gratitude’ (2023) sneakers in a US Men’s Size 7.5, and one (1) pair of each of the following sneakers, each in a US Men’s Size 7: Air Jordan 11 Retro ‘Cool Grey’ (2021), Air Jordan 11 Retro ‘Space Jam’ (2016), Air Jordan 11 Retro ‘Concord’ (2018), Air Jordan 11 Retro ‘Bred’ (2019) and Air Jordan 11 Retro ‘Pantone’ (2014) (collectively, ARV of $2,746 USD). Odds of winning a prize depend on the number of eligible entries received for each respective drawing as stated above.
All prize(s) legitimately claimed will be awarded. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. In addition, Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion thereof) of comparable or greater value whether due to the unavailability of a prize or prize component, or for any other reason. Prize(s) are non-refundable and must be accepted as awarded. No more than the stated number of prizes will be awarded. All applicable shipping fees, taxes and duties for any prizes are the sole responsibility of the recipient.
In the event a potential item winner is not able to meet the requirements for claiming the item, such winner shall not be entitled to the item, or any other item, compensation or monetary value whatsoever, and Sponsor will have no further obligation to the potential winner.
Taxes. Under prevailing federal, state, and local tax rules and regulations, a prize may constitute taxable income to a recipient. Please consult with a tax professional to discuss the tax implications of acceptance of a prize. Recipients are solely responsible for any federal, state, or local taxes that may be due on a prize or the value of a prize.
Advertising and marketing. By entering the giveaway, and in consideration of Sponsor’s potential review and evaluation of his or her entry, each participant acknowledges and agrees that his or her entry constitutes Registered User Content as defined in the Terms of Use and grants to Sponsor the non-exclusive right to use his or her entry as provided in the Terms of Use. To the maximum extent permitted by law, by accepting a prize, a participant consents on their own behalf, to the print and online publication of such participant’s Instagram username and stated country of residence as part of any announcement of the winner(s) of this giveaway on Sponsor’s website (and to submit this information, along with such winning participant’s first and last name, address, phone, email or other contact information to governmental agencies if required by applicable law) without additional compensation other than the consideration specified in this paragraph for the entire protection term of the rights concerned and for all methods and means of exploitation. Each participant whose personal information is being so used by Sponsor may request access to his or her personal information held by Sponsor and that Sponsor correct the data if it is inaccurate or delete the data if Sponsor is not required to retain it by law or for legitimate business purposes. Access, correction, deletion requests or withdrawal of consents can be made by contacting Sponsor by email at privacy@goat.com or by mail at P.O. Box 91258, Los Angeles, CA 90009-1258, however, no consent withdrawal will apply retroactively to any participant's personal information used prior to Sponsor's receipt of any consent withdrawal. Other than as set forth herein, Sponsor will treat any personal information supplied by participants in connection with the giveaway in accordance with Sponsor's Privacy Policy.
NOTE ABOUT SOCIAL MEDIA PLATFORMS. Sponsor is not responsible for any changes or unavailability of any social media platform, including, but not limited to, Instagram, that may interfere with the giveaway, including any limitations, restrictions, or conditions on Sponsor’s ability to use any social media platform for the giveaway as set forth in these Official Rules that are not acceptable to Sponsor or the inability of participants to post content, share, or communicate with Sponsor via any social media platform. A participant’s use of any social media platform is subject to the terms and conditions set by such social media platform.
LIMITATION OF LIABILITY/REQUIREMENTS. By entering, participant agrees to release, defend, hold harmless and indemnify Sponsor and its respective parents, subsidiaries, affiliates, contractors, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of any injuries, losses, or damages of any kind caused by the acceptance, possession, use or misuse of a prize awarded in the giveaway, including but not limited to any claims for damage to property, personal injury, death or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery. False or deceptive entries or acts will render the participant ineligible. By entering, participant further agrees that (i) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (ii) all causes of action arising out of or connected with this giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for any printing or typographical errors in these Official Rules or any other materials associated with the giveaway.
By entering this giveaway or accepting a prize, each recipient agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any giveaway activity, including use of a prize. Each participant further agrees to adhere to the Terms of Use, including but not limited to the prohibition on defamatory, obscene, pornographic, vulgar, or offensive content by such participants.
Participants enter at their own risk and the Sponsor is not responsible for and shall not be liable for any condition caused by events beyond its control that may cause the giveaway to be disrupted or corrupted. Failure to comply with these Official Rules may result in disqualification from this giveaway. Sponsor reserves the right to revise these Official Rules.
Should any portion of the giveaway be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the giveaway and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to such action. Sponsor reserves the right to revise these Official Rules at any time.
Choice of law/venue. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of participant and Sponsor in connection with the giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to the conflict of laws rules thereof, and any matters or proceedings shall take place in the city of Los Angeles, California.
Winning participant(s) list. For the names of the winning participant(s), send a legal-size, self-addressed, stamped envelope to: 1661, Inc. dba GOAT, attn: GOAT AJ11 Giveaway Winners’ List, P.O. Box 91258, Los Angeles, CA 90009-1258. Requests must be received no later than three (3) months following the close of the giveaway.
